Terms and Conditions for the Ask AI Workshop

1. Definitions and Scope

1.1. "Workshop" refers to the Ask AI Workshop provided by MaitrixAI.

1.2. "Participant" refers to the individual attending the Workshop.

1.3. "MaitrixAI" or "we" refers to the provider of the Workshop, its organisers, and facilitators.

2. Ticketing, Refund, and Transfer Policies

2.1. Non-Refundable Tickets: All tickets for the Workshop are non-refundable due to the significant efforts involved in planning and booking the venue and other arrangements.

2.2. Ticket Transfer: Participants may transfer their ticket to a different Workshop date, subject to availability, provided they notify MaitrixAI by emailing [email protected] at least three (3) days prior to the original event date. Failure to notify within this timeframe will result in the forfeiture of the ticket, with no refund or transfer option available.

2.3. Workshop Cancellation: In the unlikely event that MaitrixAI cancels the Workshop, participants will be offered either a full refund or the option to transfer to another date. No additional compensation or liability will be assumed by MaitrixAI.

2.4. No-Show Policy: Participants who fail to attend the Workshop (no-shows) will not be eligible for any refund or ticket transfer. MaitrixAI is under no obligation to accommodate or compensate no-shows in any form.

2.5. Notification of Refund and Transfer Policies: Participants acknowledge that all ticket purchases are final and non-refundable, as clearly displayed at checkout. Conditions for ticket transfers are displayed and agreed upon at the point of sale.

2.6. Participant Cancellations: In cases where participants are unable to attend, they must notify MaitrixAI as soon as possible. While refunds are not provided, following this procedure may allow MaitrixAI to accommodate a transfer request.

2.7. Non-Transferability of Transferred Tickets: Once a ticket transfer has been granted, it is non-transferable and may not be further transferred to another individual or workshop date.

3. Liability and Personal Property

3.1. Personal Equipment: Participants are solely responsible for the care, security, and maintenance of any personal equipment, including laptops, tablets, and mobile devices, brought to the Workshop. MaitrixAI assumes no responsibility for loss, damage, or theft of personal property.

3.2. Limitation of Liability: MaitrixAI is not liable for any personal injury or damage to property that may occur at the Workshop. Participants agree to attend at their own risk and accept full responsibility for their personal safety and belongings.

3.3. Actions of Third Parties: MaitrixAI may engage third-party vendors, including caterers and venue staff, to assist with aspects of the Workshop. MaitrixAI is not responsible for the actions, omissions, or services provided by these third-party vendors. Participants acknowledge that any concerns regarding third-party services should be directed to the third party responsible.

3.4. Limitation of Liability to the Extent Permitted by Law: To the maximum extent permitted by law, MaitrixAI disclaims all liability for any loss, injury, or damage suffered by Participants at the Workshop, whether caused by negligence or otherwise.

4. ChatGPT Subscription Requirement

4.1. Participants are required to have an active paid subscription to ChatGPT to engage in the practical components of the Workshop. It is the Participant’s responsibility to ensure their subscription is current and functional. MaitrixAI will not provide refunds or extensions for participants who cannot participate due to subscription issues.

4.2. Subscription Notification at Purchase: Participants are notified during checkout that an active paid subscription to ChatGPT is required for participation in practical Workshop activities.

4.3. No Liability for ChatGPT Access Issues: MaitrixAI is not responsible for any inability to access ChatGPT due to outages, account issues, or other factors beyond its control. Participants should confirm their access to ChatGPT before the Workshop.

5. Disclaimer for Advice Given

5.1. All information, insights, and advice provided during the Workshop are for educational and informational purposes only. MaitrixAI is not liable for any decisions or actions taken by participants based on the information provided in the Workshop. Participants are encouraged to seek professional advice tailored to their specific circumstances before making any business decisions or investments.

6. Food and Dietary Allergies

6.1. MaitrixAI may provide or arrange for food and beverages during the Workshop; however, it is the Participant’s responsibility to inform MaitrixAI of any food allergies or dietary restrictions at least seven (7) days prior to the Workshop.

6.2. Disclaimer: MaitrixAI does not guarantee an allergen-free environment and cannot be held liable for any allergic reactions or dietary-related issues that may arise during the Workshop. Participants are encouraged to bring their own food if they have severe allergies.

7. Accessibility and Accommodations

7.1. MaitrixAI is committed to providing an accessible and inclusive environment. Participants with disabilities or special needs are encouraged to notify MaitrixAI at least ten (10) days prior to the Workshop to arrange reasonable accommodations. MaitrixAI will make all reasonable efforts to accommodate such requests but cannot guarantee the availability of specific accommodations due to venue constraints or other factors.

7.2. Accessibility Limitation: MaitrixAI will make reasonable efforts to accommodate Participants with disabilities but cannot guarantee the availability of specific accommodations due to venue limitations.

8. Venue and Schedule Changes

8.1. MaitrixAI reserves the right to change the venue or alter the Workshop schedule if necessary. MaitrixAI will provide notification of any changes as soon as possible.

8.2. Non-Refundable Policy: Changes to the venue or schedule do not entitle the Participant to a refund. Participants acknowledge that such changes are part of the Workshop terms and conditions.

9. Pricing and GST

9.1. All fees and pricing displayed on the MaitrixAI website are exclusive of GST. The applicable GST rate will be added at checkout and included in the final purchase amount.

9.2. Currency: All prices are listed in Australian Dollars (AUD), and transactions will be processed in AUD.

10. Code of Conduct

10.1. Participants are expected to behave respectfully and professionally throughout the Workshop. MaitrixAI reserves the right to remove any participant who fails to adhere to these standards without refund.

10.2. Harassment-Free Environment: MaitrixAI is committed to providing an inclusive, harassment-free Workshop experience for everyone, regardless of gender, age, sexual orientation, disability, physical appearance, race, or religion.

10.3. Media and Recording Consent: By participating in the Workshop, attendees consent to being photographed or recorded. MaitrixAI reserves the right to use this media for promotional or educational purposes without additional consent or compensation.

10.4. Compliance with Workshop Policies: Participants are required to comply with all Workshop policies and instructions provided by MaitrixAI staff. Failure to do so may result in removal from the Workshop without a refund.

11. Intellectual Property

11.1. All materials, content, and intellectual property provided during the Workshop are the exclusive property of MaitrixAI. Participants are granted a limited, non-transferable license to use the content for personal, non-commercial purposes only.

11.2. Prohibited Use: Participants agree not to reproduce, distribute, or transmit any Workshop materials without the prior written consent of MaitrixAI.

11.3. Digital Reproduction and Use: Participants agree not to digitise, record, or otherwise reproduce Workshop content for any purpose, including online distribution, without written permission from MaitrixAI.

11.4. Ownership and Commercial Use: Workshop materials are for personal use only. Participants may not reproduce, sell, or otherwise use these materials for commercial purposes without the express written permission of MaitrixAI.

12. Indemnity

12.1. Participants agree to indemnify and hold MaitrixAI harmless against any and all claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of or in connection with their participation in the Workshop, including but not limited to injury, loss, or damage to personal property.

12.2. Scope of Indemnity: Participants agree to indemnify MaitrixAI against all claims, including third-party claims, damages, and expenses, arising from participation in the Workshop or any breach of these Terms and Conditions by the Participant

13. Force Majeure

13.1. MaitrixAI shall not be held liable for any failure to conduct the Workshop as scheduled due to events beyond its reasonable control, including but not limited to natural disasters, acts of government, strikes, pandemics, public health emergencies, or other unforeseen circumstances. In such cases, MaitrixAI reserves the right to cancel or reschedule the Workshop without liability or obligation to provide compensation beyond ticket transfers or refunds, as specified in the Ticketing, Refund, and Transfer Policies section.

14. Medical and Health Disclaimer

14.1. Participants acknowledge that they are responsible for their own health and well-being while attending the Workshop. MaitrixAI is not liable for any injuries or health issues that may arise due to physical activity or prolonged periods of sitting. Participants are encouraged to consult with a medical professional regarding any concerns before attending the Workshop.

14.2. Health and Safety Acknowledgement: Participants acknowledge that they are fit to participate in the Workshop and accept responsibility for managing their own health.

15. Dispute Resolution

15.1. Any disputes arising from or related to these Terms and Conditions will initially be resolved through mediation in Queensland, Australia.

15.2. If mediation is unsuccessful, the dispute will proceed to arbitration, which will be conducted under the rules of an agreed-upon arbitration body. Participants agree that arbitration shall be binding and the final recourse, waiving their right to further pursue the matter in court, except as needed to enforce an arbitration decision.

15.3. Arbitration Rules and Binding Nature: Arbitration will be conducted under the rules of the Australian Centre for International Commercial Arbitration (ACICA). Participants agree that arbitration is final and binding.

16. Governing Law

16.1. These terms and conditions are governed by the laws of Queensland, Australia. Any legal action related to these terms shall be brought in the appropriate court located in Queensland, Australia.

16.2. Acceptance of Terms: By purchasing a ticket to the Workshop, Participants confirm their agreement to these Terms and Conditions. Failure to accept these terms will prevent completion of the ticket purchase.
